Overview
This is the second in a series of two lessons focusing on the Australian Aboriginal flag. In this lesson students will consider the political use of the Australian Aboriginal flag, the intellectual property concerns of the flag’s designer, and changing cultural attitudes.

At the end of this lesson, students will be able to:

explain what is meant by intellectual property and how designs can be protected.

Procedure
Students submit their homework assignment from the previous lesson (Australian Aboriginal Flag Worksheet).
Class discussion on the various issues uncovered in their research:
What is the significance of the Australian Aboriginal flag?
How has the use of the Australian Aboriginal flag changed recently? ie as it is used by athletes such as Cathy Freeman.
How does the Australian Aboriginal flag’s designer view these events?
What are Mr Thomas’ intellectual property rights?
Why do you think he has received little recognition for his design?
Teacher provides background information on intellectual property and how one may protect original designs:
Definition: Intellectual property (IP) represents the property of your mind or intellect. Types of intellectual property include patents, trade marks, designs, confidential information/trade secrets, copyright, circuit layout rights, plant breeder's rights etc.
Definition: Design includes the features of shape, configuration, pattern or ornamentation which can be judged by the eye in finished products. Design registration is for manufactured products and NOT artistic designs. In other words, registered designs protect the way manufactured products look.
Definition: Copyright protects the original expression of ideas, not the ideas themselves. It is free and automatically safeguards your original works of art, literature, music, films, broadcasts and computer programs from copying and certain other uses.

That Aboriginal sports people should only carry the recognised Australian flag. Note: There are currently some registered designs for combined flags and a review will be held of these in about 6 months.
